Highly Skilled Migrant Scheme tightened

The conditions to qualify for a residence permit as a highly skilled migrant (knowledge migrant) are tightened. As of 19 June 2011 the salary of the highly skilled migrant has to be market level. The application will be rejected if the salary is not according market level.

If the Immigration Service (IND) has the presumption that the offered salary is not according market level, the employer will have to provide documents concerning the company itself, the educational background of the highly skilled migrant and information about the specific job the highly skilled migrant will fulfil. The Labour Directorate (UWV Werkbedrijf) will also be asked to advice whether the renumeration is according market level. The Labour Directorate will advice within 4 weeks and the IND will follow their advice.
All applications filed at 19 June 2011 or later will be assessed according this new condition.
