District Court ruling on monthly salary payment to EU Blue Card holder

24 March 2019 The Labour Inspection imposed a penalty of € 8,000 to a company employing an EU Blue Card holder, because this EU Blue Card holder did not receive its salary every month. The EU Blue Card holder did receive his salary in this case over three months paid out in one month. A condition for the EU Blue Card is a gross monthly salary pay of at least € 5,272 (2019 level). In the Dutch Highly Skilled Migrant Scheme it is a condition that the employee receives his salary every month. The district court ruled in this case (SGR 18/4163) on 21 March 2019 that the EU Blue Card regulation does not have as a condition that the salary has to be paid out each month. Due to this fact the penalty could not be imposed according the district court. High Appeal by the Ministry of Social Affairs against this ruling is still possible. We will keep you updated.
